Agreement to Terms

By accessing or using phase.fitness ("the App," "Service," "we," "our," or "us"), a product of GrowthClan Inc., you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.

Eligibility

You must be at least 13 years old to use phase.fitness. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • Your use complies with all applicable laws and regulations

Account Registration

Creating an Account

To access certain features, you must create an account by providing:

  • Valid email address
  • Secure password
  • Accurate profile information

Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access

We are not liable for losses caused by unauthorized use of your account.

Subscription Plans

phase.fitness offers two subscription tiers:

Free Plan

  • Basic workout tracking
  • Limited routine access
  • Standard features

Pro Plan

  • Advanced workout routines
  • Enhanced analytics
  • Priority support

Billing and Payments

  • Subscriptions are billed through Stripe
  • Billing cycles: monthly or annual (based on selection)
  • Automatic renewal unless cancelled
  • Prices subject to change with 30 days notice
  • No refunds for partial billing periods

Cancellation

You may cancel your subscription at any time:

  • Cancellation takes effect at the end of the current billing period
  • You retain access until the period ends
  • No refunds for unused time
  • To cancel: Go to Account Settings > Subscription > Cancel Subscription, or contact info@growthclan.com

Hevy Integration

Authorization

By connecting phase.fitness to Hevy:

  • You authorize us to access your Hevy workout data
  • You confirm you have the right to share this data
  • You can revoke access at any time

Data Sync

  • Workout data syncs automatically (when authorized)
  • Sync frequency may vary
  • We are not responsible for data discrepancies with Hevy
  • Hevy's terms of service apply to their platform

User Responsibilities

Acceptable Use

You agree NOT to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or viruses
  • Attempt to hack or reverse engineer the App
  • Scrape or harvest data from the Service
  • Impersonate others or provide false information
  • Harass, abuse, or harm other users
  • Use the App for commercial purposes without authorization

Workout Safety

  • Medical Disclaimer: Consult a healthcare professional before starting any fitness program
  • We do not provide medical advice
  • You use workout routines at your own risk
  • We are not liable for injuries sustained while using the App

Content Ownership

  • You retain ownership of your workout data
  • By using the Service, you grant us a license to use your data to provide and improve phase.fitness
  • We may use anonymized, aggregated data for analytics

Intellectual Property

Our Rights

phase.fitness owns all rights to:

  • App design, code, and functionality
  • Logos, trademarks, and branding
  • Workout routines and content we create
  • Algorithms and AI models

License to Use

We grant you a limited, non-exclusive, non-transferable license to use phase.fitness for personal, non-commercial purposes.

You may NOT:

  • Copy, modify, or distribute the App
  • Create derivative works
  • Remove copyright notices
  • Use for competitive purposes

Third-Party Services

phase.fitness integrates with:

  • Hevy (workout tracking)
  • Stripe (payment processing)

These services have their own terms and privacy policies. We are not responsible for third-party services.

Disclaimers

"AS IS" Service

phase.fitness is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Uninterrupted or error-free operation
  • Accuracy or reliability of data
  • Specific results or outcomes

No Medical Advice

  • We are not healthcare providers
  • Information is for general educational purposes
  • Always consult professionals for medical advice

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid in the last 12 months
  • We are not liable for injuries, losses, or damages from using workout routines

Indemnification

You agree to indemnify and hold harmless phase.fitness from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights

Termination

By You

You may terminate your account at any time by:

  • Cancelling your subscription
  • Requesting account deletion

By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse the Service
  • Fail to pay subscription fees

Upon termination:

  • Your access is immediately revoked
  • Your data will be deleted per our Privacy Policy
  • Outstanding fees remain due

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

  • Immediately upon posting for minor changes
  • 30 days after notice for material changes

Continued use after changes constitutes acceptance.

Dispute Resolution

Governing Law

These Terms are governed by California law, without regard to conflict of law provisions.

Arbitration Agreement

Any disputes shall be resolved through binding arbitration in San Francisco, California, except:

  • Small claims court matters
  • Intellectual property disputes

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION.

Exceptions

Nothing prevents either party from seeking injunctive relief in court for:

  • Intellectual property infringement
  • Data breaches
  • Violation of confidentiality

General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and phase.fitness.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver

Our failure to enforce any provision does not waive our right to do so later.

Assignment

You may not assign these Terms. We may assign them to affiliates or acquirers.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

Users 13-17

If you are between 13-17 years old:

  • You must have parental/guardian consent
  • Parents/guardians are responsible for your compliance
  • We may require verification of consent

Beta Features

We may offer beta or experimental features:

  • These are provided "AS IS"
  • May be unstable or change without notice
  • Your feedback helps us improve
  • No guarantees of continued availability

By using phase.fitness, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
